Data Processing Addendum

This Data Processing Agreement (“Agreement”) is part of the terms and conditions governing the services provided by Get BOB LLC (“we,” “our,” “us”, “Get BOB”). By accepting this Agreement, you agree to the terms set forth regarding the handling and processing of your personal data.

 

1. Definitions

Key terms such as “Personal Data,” “Processing,” “Data Subject,” “Controller,” “Processor,” and “Sub-processor” are defined in accordance with applicable data protection laws.

 

2. Processing Purpose and Duration

The purpose of data processing under this Agreement is to provide you with the specified services offered by Get BOB. Processing will continue for the duration of your use of these services or as required by applicable law.

 

3. Obligations of the Parties

Get BOB Obligations:

  • We will process your personal data solely based on your documented instructions, unless otherwise required by law.
  • Get BOB will maintain the confidentiality of personal data and implement appropriate technical and organizational security measures.
  • We will notify you promptly if we become aware of any personal data breaches that could impact your data security.

Your Obligations:

  • You are responsible for ensuring the accuracy, completeness, and legality of the data you provide to Get BOB for processing.
  • You must notify Get BOB of any changes in your instructions related to personal data processing.

 

4. Sub-processing

To provide our services effectively, we may engage Sub-processors who comply with comparable data protection obligations as outlined in this Agreement. Get BOB currently uses the following Sub-processors:

  1. OpenAI - https://openai.com: For Large Language Model (LLM) capabilities, providing natural language processing and AI-driven features.
  2. Amazon Web Services (AWS) -  https://aws.amazon.com: For cloud hosting and data storage, including EC2 for application hosting and S3 for file storage.[/size]
  3. Bubble.io - https://bubble.io: Platform used for app development and hosting, managing backend and frontend services.
  4. Engagespot - https://engagespot.co: Enhances user notifications and engagement through messaging and alerts.
  5. Stripe - https://stripe.com: For secure payment processing.
  6. HubSpot - https://hubspot.com: CRM for managing customer relationships and communications.
  7. SendGrid - https://sendgrid.com: Programmatic email sending for notifications and transactional emails.
  8. Google Services - https://google.com: Includes Google Cloud for hosting and data storage, Google Analytics for tracking and analytics, Google Tag Manager for managing website tags.
  9. Mixpanel - https://mixpanel.com: For product analytics, helping us understand user behavior and improve the Get BOB platform
  10. Microsoft Clarity - https://clarity.microsoft.com: To analyze user interactions on our platform, enhancing usability and experience.
  11. Pipedream - https://pipedream.com: To facilitate user-initiated integrations between Get BOB and other applications.

We will inform you of any intended changes concerning the addition or replacement of Sub-processors, giving you an opportunity to object if you have legitimate reasons.

 

5. Rights of Data Subjects

Get BOB will assist you in responding to requests from Data Subjects exercising their personal data rights, in accordance with applicable data protection laws. These rights may include access, rectification, deletion, and data portability, among others.

 

6. Data Security and Breach Notification

We commit to implementing appropriate technical and organizational measures to protect your personal data. In the event of a data breach involving personal data, we will notify you without undue delay and provide information on the breach, its potential impact, and the steps taken to address it.[/font]

 

7. Audit Rights

You have the right to request audits or inspections to verify our compliance with this Agreement. Audits will be conducted under reasonable conditions to ensure minimal disruption to Get BOB operations, and any sensitive information will be protected.

 

8. Data Retention and Deletion

We will retain your personal data only as long as necessary to provide our services or as required by applicable law. Upon termination of services, personal data will be securely deleted, unless retention is legally mandated.

 

9. International Transfers

If personal data is transferred internationally, Get BOB will ensure that such transfers are carried out in compliance with applicable data protection laws and relevant safeguards, such as Standard Contractual Clauses or other lawful mechanisms.

 

10. Legal Effect and Changes

This Agreement is legally binding upon your acceptance during the signup process. Get BOB reserves the right to amend this Agreement as required by changes in law or business practices. Any modifications will be communicated to you, and your continued use of the services constitutes acceptance of the revised terms.

 

11. Governing Law and Jurisdiction

This Agreement is governed by the laws of Texas, USA. Any disputes related to this DPA will be resolved exclusively in the courts of Texas, USA.

 

12. Acceptance

By signing up to use our services, you acknowledge and agree to the terms outlined in this Data Processing Agreement, which detail how your personal data will be processed and protected by Get BOB.
